2. Purpose

These Terms define the conditions for accessing and using the Ekomo mobile application, dedicated to fitness training, progression tracking, and premium subscription features.

3. Acceptance

By creating an account or using the app, the user accepts these Terms and the Privacy Policy.

If the user does not agree, they must stop using the app.

4. User account

1. Full access requires an account (magic link email, Apple, Google).

2. The user agrees to provide accurate and up-to-date information.

3. The user is responsible for account and device confidentiality.

4. The publisher may suspend or delete an account in case of abuse, fraud, or breach of these Terms.

5. Features

Ekomo includes:

  • Training plans/sessions and progression tracking
  • Workout history and records
  • Premium features via in-app purchase
  • Local notifications (e.g., timer)

Features may be changed, improved, or removed.

6. Subscriptions and in-app purchases

1. Premium subscriptions are offered via Apple App Store / Google Play.

2. Payments are handled by the store platform, not directly by the publisher.

3. Unless stated otherwise, subscriptions auto-renew.

4. Users can manage or cancel subscriptions in their App Store/Google Play account settings.

5. Cancellation takes effect at the end of the current billing period; prorated refunds are not guaranteed unless required by platform policy or applicable law.

6. Purchase restoration is available through the "Restore" feature when applicable.

7. Account deletion

Users may request/delete their account from within the app.

Deletion removes associated data, subject to legal retention obligations.

8. Code of conduct

Users must not:

  • Bypass, disrupt, or compromise service security
  • Use abusive automation/scripts
  • Use the service fraudulently
  • Infringe the publisher's intellectual property rights

9. Health and safety - important limitation

Ekomo provides training content for informational/coaching purposes.

The app is not a medical device and does not provide medical advice.

Users are solely responsible for:

  • Their health condition
  • Adapting exercises to their physical condition
  • Consulting a healthcare professional in case of doubt, pain, illness, pregnancy, rehabilitation, or contraindication

The publisher is not liable for harm resulting from improper exercise execution, unsuitable usage, or failure to follow health precautions.

10. Intellectual property

All app elements (trademarks, texts, design, code, databases, content) are protected by intellectual property rights.

Unless expressly authorized in writing, any reproduction, extraction, distribution, or exploitation is prohibited.

11. Availability

The publisher aims for reasonable service availability but does not guarantee uninterrupted or error-free operation.

The service may be interrupted for maintenance, updates, security, or technical constraints.

12. Liability

To the extent permitted by law, the publisher is not liable for:

  • Indirect damages
  • Data loss caused by external factors or user actions
  • Temporary unavailability of third-party services (App Store, Play Store, cloud providers)

Total liability of the publisher, for all damages combined, is limited to amounts paid by the user for the service over the previous 12 months, unless mandatory law provides otherwise.

13. Personal data

Personal data processing is described in the Privacy Policy, which forms an integral part of these Terms.

14. Changes to these Terms

These Terms may be changed at any time.

The version in force is the one published in the app/website on the consultation date.

In case of material changes, users are informed through an appropriate channel.

15. Governing law and disputes

  • Governing law: French law
  • Competent courts: Courts of Paris, France

For EU consumers, mandatory rights of the country of habitual residence remain applicable.
